Online Waiver & Release of Liability**

By checking the acknowledgment box, clicking “I Agree,” or otherwise completing registration through the DB Pickleball Social website or affiliated platforms, you (“Participant”) acknowledge that you have read, understood, and agreed to the following Online Waiver & Release of Liability.

Activities Covered: All pickleball activities, including but not limited to open play, leagues, tournaments, clinics, events, and any related activities offered by DB Pickleball Social (“Club”), whether on-site or at affiliated locations.

1. Assumption of Risk

Participant understands that pickleball and related activities involve inherent risks, including but not limited to slips, falls, collisions, overexertion, equipment failure, serious bodily injury, permanent disability, paralysis, death, and property damage. Participant voluntarily assumes all known and unknown risks associated with participation, including risks arising from the negligence of the Club.

2. Release and Waiver of Liability

Participant hereby releases, waives, discharges, and agrees not to sue DB Pickleball Social, its owners, officers, directors, employees, agents, volunteers, contractors, sponsors, and affiliates (collectively, the “Released Parties”) from any and all claims, liabilities, demands, damages, losses, or causes of action arising out of or related to participation in Club activities, including those caused by the negligence of the Released Parties, to the fullest extent permitted by law.

3. Indemnification

Participant agrees to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, or expenses (including attorneys’ fees) arising from Participant’s actions, omissions, or participation in Club activities.

4. Medical Authorization

Participant authorizes the Club to seek emergency medical treatment on their behalf if necessary and agrees that Participant is solely responsible for all costs associated with medical care. The Club does not provide medical insurance coverage.

5. Physical Condition & Eligibility

Participant represents that they are physically capable of participating in pickleball activities and have no condition that would increase the risk of injury. Participant agrees to stop participating immediately if they feel unsafe or unwell.

6. Compliance with Club Rules

Participant agrees to comply with all posted rules, safety guidelines, and staff instructions. Failure to comply may result in removal from activities without refund.

7. Photography & Media Release

Participant grants DB Pickleball Social the irrevocable right to use photographs, video recordings, or other media taken during activities that include Participant’s likeness for marketing, promotional, or educational purposes, without compensation.

8. Communicable Illness Acknowledgment

Participant acknowledges that participation in group athletic activities carries a risk of exposure to communicable illnesses and voluntarily assumes all related risks.

9. Electronic Agreement & Consent

Participant agrees that this waiver is executed electronically and that electronic acknowledgment (including checking a box, clicking acceptance, or completing registration) constitutes a legally binding signature. Participant agrees that this waiver is enforceable to the same extent as a handwritten signature.

10. Severability

If any portion of this agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Acknowledgment

By completing registration and electronically accepting this waiver, Participant confirms that they have read and understand this agreement, understand that they are waiving substantial legal rights, and voluntarily agree to all terms.
